TERMS OF USE

Welcome to STREAMEE, a service provided by MCN STUDIOS PRIVATE COMPANY (the Company)!

STREAMEE is the new application to listen to the radio, enjoy the most pop-up podcasts, keep you updated on music, and other, news, talk to your favorite producers via chat, listen to music from all over the world, play in competitions! STREAMEE follows you on all your devices (mobile, tablet, smartwatch, TV, car) & on your computer (web), without any difficulty!

The present Terms of Use analyze the terms and conditions relating to your access to and use of the STREAMEE service and constitute your legally binding Agreement with the Company.

The STREAMEE service consists of the STREAMEE software application that you can install on your computer, mobile phone, tablet or any other electronic device, either directly or through third parties and the website www.streamee.com

Please read the Terms of Use carefully. By registering/subscribing for the STREAMEE service and using it or by accessing music, videos or other material made available through the STREAMEE service (“Content”) you expressly and unreservedly declare that you have read, understood and accepted that you are bound by this Agreement and its Terms of Use.

The Terms of Use apply to both subscribers and non-subscribers.

If you do not agree with this Agreement you may not use the STREAMEE service and access its content.

Amendment to the Agreement

The Terms of Use are subject to unilateral amendment by the Company, without prior notice. The amended Terms will be published immediately and will be deemed binding upon you after they are published.

In case of significant modifications, the Company will notify you in the appropriate way, as the case may be, such as, indicatively, by sending an e-mail or by an app notification and/or by an indication which will require your acceptance. Please read carefully any notice sent and/or posted. If you continue to use the service after the notice you accept all amendments to the Terms of Use.

If you do not wish to continue using the service after the modifications you can terminate your account.

Use of the STREAMEE service

Users are divided into subscribers and non-subscribers/visitors. Users who do not subscribe to the service (visitors) can only access certain features of the application. Users who subscribe to the STREAMEE service (subscribers) create their own Account and gain access to all its content.

No payment is required for the subscription and/or use of the Account. Subscription and further benefits are free of charge. Only STREAMEE coins are used, which subscribers can “spend” within the service.

Intellectual Property

The STREAMEE service and the Content are the property of the Company or its licensors.

The Company provides you with a limited, non-exclusive, revocable, non-transferable and free license to access and use the STREAMEE service and the Content. Access and use are only personal and non-commercial, and must be in accordance with the Terms of Use hereof.

STREAMEE’s software applications and its content remain the property of the Company and its licensors and are not transferred to you, even after their installation on your devices (computers, mobile phones, tablets, etc.).

You may not transfer or in any way redistribute, exploit, publish, republish, download, reproduce, copy in mechanical or other manner, by processing or without, transfer, transmit or make available to the public, part or all of the STREAMEE service and/or the Content.

You agree that you will not use the STREAMEE service in an illegal manner and will not attempt to access it without authorization. It is strictly forbidden for you to collect or store and/or process personal data of third parties without their explicit consent.

It is forbidden to decompile the software and/or to process the source code in any way and/or reverse engineer, disassemble, or create derivative works based on the STREAMEE service and/or its Content.

In case you have access to “streaming” services, it is strictly forbidden to store the “stream” by any technical method in any form, in whole or in part.

Any unauthorized intervention to cancel or circumvent the security measures of the STREAMEE service is prohibited and prosecuted in accordance with the law.

STREAMEE trade name, trademarks and distinctive signs used and posted on the STREAMEE service (Trademarks) are the exclusive property of the Company or its licensors. Under no circumstances are you granted the right to use the above Trademarks for either commercial or non-commercial use.

The publication of an electronic link to the website streamee.com is permitted provided that it takes place in a lawful and legitimate manner, is not misleading or deliberately harmful to the Company’s reputation, and is not intended to obtain unfair benefit from the Company’s reputation. The publication of an electronic link in a way that indicates some form of affiliation, approval or acceptance by the Company, while such does not exist, is strictly prohibited. The Company reserves the right to revoke any license to use its website as a link, without prior notice.

Subscription

If you subscribe to the STREAMEE service and create your own Account, we will ask you to provide information about your username, password, e-mail address, country. You hereby agree that:

You will provide accurate and complete information and will not use a username and passwords that you are not allowed or authorized to use. The Company may reject or revoke, at any time, your right to use any name as part of the username in the STREAMEE service, without incurring any liability.

You are responsible for safeguarding the privacy of your password so that third parties cannot use your name, username and password. You will not allow third parties to access your Account, and you will notify us promptly in the event of unauthorized access to your Account by a third party. The Company will not be liable for any damage to you in the event that a third party uses your username, password or Account without authorization, with or without your knowledge, before you notify us of the unauthorized use of the above.
You undertake the responsibility for all activities that take place in your Account.

You must comply with applicable laws and not use the STREAMEE service and/or its Content illegally and/or abusively. You are responsible for any damage that may be caused by your illegal and/or abusive use of the STREAMEE service and/or its Content.

The Company reserves the right to “deactivate” your Account and/or take any other measure it considers appropriate, such as, indicatively, to limit your access to the Account, for any reason, especially in the event that activities that violate the Terms of Use, cause damage and/or harm to the STREAMEE service, violate the rights of third parties, harm the reputation of the Company and/or violate the law, take place in your Account.

User Content – User Behavior Rules

If you have access to communication services through the STREAMEE service, such as, indicatively, online chat services, e-mail communication services, you accept by using these services that:

You are responsible for the content of your comments in the chat or any other area that comments are allowed. When you post or in any way make accessible any content, you warrant that you have the right to post that content, that you do not violate third party rights (copyright, personality rights etc.), that you have all the necessary licenses to use the content and that you release the Company from any liability or any other kind of claims. You declare that the person responsible for this content is solely the person from whom it originated/was created.

The Company is not obliged to control your content. The Company is not responsible for any errors, omissions or illegal, immoral, offensive, abusive, intimidating, inaccurate and/or inappropriate for minors/children etc. content which is accessible through the STREAMEE service by users.

The Company is not responsible for any harm you may suffer from accessing or using the content uploaded by other users to the application.

You will not upload, submit or in any way make accessible any content that: is illegal, harmful, defamatory, offensive, obscene, insulting, pornographic, intimidating, violates someone else’s privacy, shows hostility, or expresses racial, ethnic or other discrimination, may cause harm to minors in any way, is not permitted to be transmitted in accordance with law or contractual or managing relationships (such as internal information, trade secrets and confidential information obtained or disclosed as part of employment relationships or covered in confidentiality agreements), violates any, patent, trademark, trade secret, copyright or other exclusive rights of third parties, contains software viruses or any other codes, files or programs, designed for the purpose of termination, causing damage, destroying or obstructing the operation of any software or computer hardware, deliberately or unintentionally violates the applicable Greek and EU legislation and its provisions, promotes the conduct of criminal acts, exploits communication and other services to promote commercial messages of any kind (eg. advertising, competitions, promotional activities), may harass third parties in any way and any content and/or is used for the collection or storage of personal data about other users.

The Company has the right to disclose the details of the infringers to the competent Authorities and to the affected persons for the exercise of their legal rights, in accordance with applicable legislation, and may itself claim from the person responsible any damage that may be suffered by such behavior.

It is forbidden to disrupt the conversations that take place in real time and in non-real time (sms, e-mails) by sending annoying, repetitive, meaningless and/or exorbitant messages and/or by transmitting unsolicited mass mails or other forms of uninvited messages (spam).

If anyone raises a claim against the Company relating to the content you have posted, you will be required to indemnify the Company for any damages and expenses of any kind, to the extent permitted by applicable law.

By posting content you grant the Company (and any of its subsidiaries and affiliates) a non-exclusive, indefinite, transferable, irrevocable, free license to use such content. At the same time, you give us permission to provide advertising and other information to you and to allow our business partners to do the same.

If you provide comments, ideas or suggestions to the Company in relation to the STREAMEE Service or the Content, you acknowledge that the comments are not confidential and may be used by the Company.

Posting any of your content that violates the Terms of Use may result in your Account being suspended or immediately disabled.

Monitoring

The Company may, but is not obliged to, review and monitor your content. In any case, the Company may, at its sole discretion, take any action it deems appropriate or necessary, such as removing or disabling your access to any content for any reason, especially when it violates the Terms of Use, or deactivate your Account and/or notify the competent authorities.

Third-party Content

These are, indicatively, the radio programs, podcasts and any other content that the STREAMEE service enables you to listen to, the photos, images, texts and other material that any third party can record, provide, upload, or in any way transmit and any link to online pages.

The above content is the property of third parties and is protected under the relevant intellectual property laws. You may not transfer or in any way redistribute, exploit, publish, republish, download, reproduce, copy in mechanical or other manner, by editing or without, the content of a third party without his/her prior permission, unless permitted by applicable law.

For the transmission of their content, third parties may use a series of intellectual property rights protection mechanisms designed and introduced for this very purpose. The Company does not guarantee access to third party content and is not responsible in case you do not have access and/or cannot use the content of a third party. The right holders of third-party content may modify, delete or block or restrict access to their content at any time, with or without prior notice. Third-party content may be modified at any time.

The Company is not responsible for the type of third party content that is accessible through the STREAMEE service. The content of a third party is not subject to review and/or approval.

Third-party applications and devices

The STREAMEE service integrates or interacts with third-party applications and/or services and/or devices. Your use of these apps and devices will be governed by the terms and conditions of the third parties.

The Company has no responsibility for the features or content of the above third-party applications and devices or for any transaction you may enter into with them.

Third-party advertisements and promotions

The Company may post advertisements or other promotional activities of third parties through the STREAMEE service. Your participation in the above actions concerns only you and third parties and is subject to the terms and conditions associated with them. By using the STREAMEE service you agree that the Company is not responsible for any damage or loss suffered by you from your participation in these promotions.

STREAMEE service restrictions and modifications

The Company will make reasonable efforts to keep the STREAMEE service operational. Some technical problems, tasks, updates may sometimes lead to a temporary interruption.

The Company does not guarantee that the operation of the STREAMEE service will be uninterrupted, without errors or viruses or that any defects in the system will be repaired.

The Company is not responsible for the deletion or inability to store your content, communications and personal settings.

The Company at its sole discretion may from time to time modify features, functions or content available through the STREAMEE service, without prior notice. The Company will not be liable to you or third parties for the above modifications and/or in case of change, suspension or interruption of the STREAMEE service. If you are not satisfied or do not wish to see the above changes, then you can stop using the STREAMEE service.

YouTube Terms of Service

Streamee can create feeds that pull in content directly from YouTube Channels. By using YouTube feeds, users are agreeing to be bound by the YouTube Terms of Service https://www.youtube.com/t/terms

Term and termination

The term of this Agreement begins with the first use of the STREAMEE service by you and ends upon its termination either by you or by the Company.

This Agreement is terminated immediately upon deletion of the STREAMEE service from your devices and termination of your use of all its services and/or the cancellation of your Account. Termination may take place at any time. The Company may limit, suspend or terminate immediately and without penalty the present, at any time, without prior notice, for any reason, indicatively in case of violation of any of the Terms of Use by you. In case of withdrawal of the STREAMEE service and/or its Content, prior notice will be given.

The Company is not liable to you or any third party for the termination of the STREAMEE service and/or the termination of your use of the STREAMEE service. Upon termination you will stop accessing any content (of the Company, yours or third parties). The Company has no obligation to keep any information that may be stored on the data base associated with your account.

Limitation of Liability

The Company does not make any representation and does not guarantee the STREAMEE service and/or its Content. The Company makes every effort to ensure the accuracy of its information, but in no case shall it be liable for any untrue, inaccurate or incomplete information included in the STREAMEE service. STREAMEE’s Content is entertaining and not informative, and you cannot base your behavior on information contained therein. The Company bears no responsibility for loss or damage caused to you or third parties by the use of information included in the STREAMEE service. At the same time, the Company assumes no responsibility for the content of third parties, as discussed above, any advertisements, promotions and/ or services that may be offered by third parties through the STREAMEE service and is not responsible for any transaction between you and any third parties.

The STREAMEE service and its Content are provided “as is” and “as available” without any express or implied warranty or condition of any kind. The Company does not provide any guarantee of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement.

The Company makes no guarantee for the safety of the STREAMEE service and its Content from viruses or other programs that may cause damage. The Company is not responsible for any loss of data that may result from your inability to make proper use of it.

To the fullest extent permitted by applicable law, you release the Company from any claim, liability and/or demand you may have arising from the use of the STREAMEE service and/or the Content.

To the fullest extent permitted by applicable legislation, the Company is not civilly or criminally liable for any damage (positive, special or consequential, which indicatively and not restrictively, alternatively and/or cumulatively consists of loss of profits, data, lost profits, pecuniary compensation, etc.) that you or a third party may suffer from a cause related to the operation or not and/or the use of the STREAMEE service and/or its Content and/or inability to provide services and/or information available through it.

Protection of personal data

The Company complies with the General Data Protection Regulation. For more information on the processing of your personal data, your rights and how to exercise them, you can visit the relevant website of the Company (Privacy Policy).

Protection of intellectual property

Activity that may infringe intellectual property rights is not tolerated by the Company. Upon any notice to that effect from an intellectual property owner, the Company will remove any material from the STREAMEE service that we believe infringes third party intellectual property rights which are accessed via the STREAMEE Service.

Applicable Law and Jurisdiction

The present Terms of Use are governed by and construed in accordance with the law and laws of Greece and for any dispute arising from this agreement, exclusive jurisdiction is defined by that of the Greek courts.

The Company does not guarantee that the material in the STREAMEE service is suitable, lawful, available for use in countries other than Greece. Those who wish to access or use the STREAMEE service outside Greece are responsible for their compliance with the laws in force in their country, in case Greek law is not applicable.

Use – Age

If you are under the age of 18 you cannot access and/or use the STREAMEE service or register to create your own Account.

Entire Agreement

The above Terms together with the “Privacy Policy” bind the parties (you and the Company) as a whole and constitute the entire agreement of the parties and supersede any and all previous and current agreements between you and the Company.

Assignment

The Company may assign the Agreement and any of its rights and obligations under it. You may not assign the Agreement, in whole or in part, or transfer your rights under the Agreement to any third party.

Consent

If you use the STREAMEE service you accept and consent to the Privacy Policy as well as to the present Terms of Use.

“STREAMEE LOYALTY PROGRAM” TERMS OF USE

Welcome to the STREAMEE LOYALTY PROGRAM, a service provided by MCN STUDIOS IKE (hereinafter for short “the Company”), within the framework of the STREAMEE application.

The STREAMEE LOYALTY PROGRAM is a loyalty program for registered users of the STREAMEE application. As the 1st loyalty program for registered users of music content application in Greece, the user of the application is given the opportunity to participate in contests and win unique gifts.

These Terms of Use, detail the terms and conditions regarding the use of the STREAMEE LOYALTY PROGRAM service and constitute your legally binding Agreement with the Company.

Please read these Terms of Use carefully. By registering for and using the STREAMEE LOYALTY PROGRAM service, you expressly and unconditionally represent that you have read, understand and agree to be bound by this Agreement and its Terms of Use.

The Terms of Use apply to registered users of the STREAMEE application.

If you do not agree to this Agreement, you cannot use the STREAMEE LOYALTY PROGRAM service and access its content.

Modification of the Agreement

The Terms of Use are subject to unilateral modification by the Company without prior notice. The modified Terms will be published immediately and will be considered binding on you after their publication.

In the event of significant modifications, the Company will notify you in an appropriate manner, as the case may be, including, but not limited to, by e-mail or notification in the application and/or by a sign to your acceptance. Please read carefully any notice sent and/or posted. If you continue to use the service after the notice, you agree to accept all modifications to the Terms of Use.

If you do not wish to continue using the service after the modifications you may terminate your account.

Use of the STREAMEE LOYALTY PROGRAM service

The STREAMEE LOYALTY PROGRAM, as a loyalty program for loyal users of the STREAMEE application, has a “digital” coin that each user can earn by listening to music & podcasts through the STREAMEE application from any device (mobile phone, tablet, TV, watch, car and computer) and allows them to participate in contests and win unique prizes.

This “Digital” coin has a name and it’s called “Streamee Coin”!

In the “My Streamee Coins” category, the user can find out how the Streamee Coins are collected, their number and any general information about what the Streamee Coins mean to him/her. In more detail:

B) Category “Contests”

In this category, the user can find the contest of the STREAMEE LOYALTY PROGRAM, the cost of these contests in Streamee Coins, as well as the terms and conditions for participation in them.

Intellectual Property

The STREAMEE LOYALTY PROGRAM service and its Content are the property of the Company or its licensors.

The Company grants you a limited, non-exclusive, revocable, non-transferable, and royalty-free license to access and use the STREAMEE LOYALTY PROGRAM service and its Content. Access and use is for personal and non-commercial use only and must be in accordance with the Terms of Use herein.

The STREAMEE LOYALTY PROGRAM software applications and its Content remain the property of the Company and its licensors and are in no way transferable to you.

You may not transfer or in any way redistribute, exploit, publish, republish, download, reproduce, copy by mechanical or other means, with or without editing, transfer, transmit or make available to the public, in whole or in part, the STREAMEE LOYALTY PROGRAM service and/or its Content.

You agree that you will not use the STREAMEE LOYALTY PROGRAM service in an illegal manner and will not attempt to access it without authorization. Your collection or storage and/or processing of personal data of third parties without their express consent is strictly prohibited.

Decompilation of the software and/or editing of the source code in any way and/or reverse engineering, disassembly, or creation of derivative works based on the STREAMEE LOYALTY PROGRAM service and/or its Content is prohibited.

Any unauthorized interference for the purpose of invalidating or circumventing the security measures of the STREAMEE LOYALTY PROGRAM service is prohibited and will be prosecuted according to law.

The publication of an electronic link to the website www.streamee.gr is permitted, provided that it is done in a legal and fair manner, is not misleading or intentionally damaging to the Company’s reputation, and is not intended to obtain an unfair advantage from the Company’s reputation. The publication of an electronic link in a manner that suggests any form of cooperation, approval or endorsement by the Company, when none exists, is strictly prohibited. The Company reserves the right to revoke any license to use its website as a link without prior notice.

Registration

When you register for the STREAMEE service and create your own account as a silver user, we will ask you to provide information about your username, password and e-mail address.

You hereby agree that:

– You will provide accurate and complete information and will not use username and passwords that you are not permitted or authorized to use. The Company may reject or revoke, at any time, your right to use any name as part of your username on the STREAMEE LOYALTY PROGRAM service, without liability.

– You are responsible for maintaining the confidentiality of your password so that third parties cannot use your name, username and password. You will not allow third parties to access your Account and will notify us immediately in the event of unauthorised access to your Account by an unauthorised third party. The Company will not be liable for any loss to you in the event that a third party uses your username, password or Account without authorization, with or without your knowledge, before you notify us of such unauthorized use of the foregoing.

– You assume responsibility for all activities that take place on your Account.

You must comply with applicable laws and not use the STREAMEE LOYALTY PROGRAM service and/or its Content illegally and/or improperly. You are responsible for any damage that may be caused by your illegal and/or abusive use of the STREAMEE LOYALTY PROGRAM service and/or its Content.

The Company reserves the right to “deactivate” your account and/or take any other measure it deems appropriate, including but not limited to restricting your access to the Account, for any reason, especially in the event that activities take place on your Account that violate the Terms of Use, cause damage and/or harm to the STREAMEE LOYALTY PROGRAM service, violate the rights of third parties, damage the Company’s reputation and/or violate the law.

No payment is required to register and/or use the Account. Registration and further benefits are free of charge. Only Streamee Coins are used, which only registered users can “spend” within the service.

General Conditions of Contests

The contests are conducted electronically via the STREAMEE application, through which the winner will be drawn.
Those who are at least 18 years of age are eligible to participate in the contests.
Employees of the Company, their first and second degree relatives and their spouses are excluded from participation in the contests.
For participation in the contests, there is no charge or any kind of financial burden on the participants, as long as they are registered as users and pay the required Streamee Coins as a ”fee”, which are indicated at the top right of the respective contest box.
Each user can participate without any limitation in as many contests as they wish, with the possibility of multiple entries in each contest by paying the respective Streamee Coins.
The winner will be declared after a draw by the Company.
Participation in the contest constitutes automatic and unconditional acceptance of these Terms of Use, without any further charge or procedure.
Upon declaration of each winner, the Company will request the full details of each winner (name, full address, mobile phone number) to enable verification of identity upon delivery of the prize. Personal data will be handled in accordance with the applicable legislation.
The gift is specific, personal and is not exchangeable, nor can it be requested to be replaced with another or redeemed in cash, at any price. The gift to be delivered under these terms and conditions is provided in the condition in which it has and is found, excluding the application of the seller’s liability provisions or other provisions establishing liability with regard to actual defects, agreed properties, etc., towards the Company.
The Company shall not be liable in any way, criminal or civil, to any winner or third party, for any accident and/or damage and/or injury and/or physical or material damage caused to them directly or indirectly related to the prize or for any other cause. The COMPANY is exempted from the obligation to deliver a gift in case the conditions of participation in the contest have not been met in any way.
The COMPANY reserves the right to modify the terms of the contest, to change the offered prizes, to extend or shorten the duration of the Contest and without notice.
Any dispute that may arise in connection with the respective contest shall be referred exclusively to the courts of Athens and Greek law shall apply.

Control

The Company may, but is not obliged to, control and monitor your account. In any case, the Company may, in its sole discretion, take any action it deems appropriate or necessary, such as removing or disabling your access to any content for any reason, especially when it violates the Terms of Use, or disabling your Account and/or informing the competent authorities.

Third party applications and devices

The STREAMEE LOYALTY PROGRAM service integrates or interacts with third party applications and/or services and/or devices. Your use of these applications and devices by you will be governed by the terms and conditions of the third parties.

The Company has no responsibility for the features or content of the aforementioned third party applications and devices or for any transaction you may enter into with them.

STREAMEE LOYALTY PROGRAM service limitations and modifications

The Company will make reasonable efforts to keep the STREAMEE LOYALTY PROGRAM service operational. Certain technical problems, operations, updates may sometimes result in temporary interruption.

The Company does not guarantee that the operation of the STREAMEE LOYALTY PROGRAM service will be free of interruptions, errors or viruses or that any defects in the system will be corrected.

The Company is not responsible for the deletion or failure to store your content, communications and personal settings.

The Company in its sole discretion may from time to time modify features, functionality or content available through the STREAMEE LOYALTY PROGRAM service without prior notice. The Company shall not be liable to you or any third party for the above modifications and/or in the event of any change, suspension or discontinuance of the STREAMEE LOYALTY PROGRAM service. If you are not satisfied with or do not wish to make the above changes, then you may discontinue using the STREAMEE LOYALTY PROGRAM service.

Duration and termination

The term of this Agreement begins upon your first use of the STREAMEE LOYALTY PROGRAM service and ends upon termination by either you or the Company.

This Agreement shall terminate immediately upon the deletion of the STREAMEE LOYALTY PROGRAM service through the STREAMEE application and the termination of the use of all its services and/or the cancellation of your Account by you. Termination may occur at any time. The Company may restrict, suspend or terminate this immediately and without prejudice at any time, without prior notice, for any reason whatsoever, including, but not limited to, in the event of a breach of any of the Terms of Use by you. Prior notice will be given if the STREAMEE LOYALTY PROGRAM service and/or its Content is withdrawn.

The Company shall not be liable to you or any third party for termination of the STREAMEE LOYALTY PROGRAM service and/or termination of your use of the STREAMEE LOYALTY PROGRAM service. Upon termination, you will cease to have access to any content (of the Company, your own or third parties). The Company has no obligation to maintain any information, if any, stored in the database associated with your Account.

Limitation of Liability

The Company does not make any representations or warranties about the STREAMEE LOYALTY PROGRAM service and/or its Content. The Company makes every effort to ensure the accuracy of its information, but in no event shall the Company be liable for any untrue, inaccurate or incomplete information included in the STREAMEE LOYALTY PROGRAM service. The STREAMEE LOYALTY PROGRAM service Content is entertainment and not informational and you may not base your conduct on any information contained therein. The Company shall not be liable for any loss or damage caused to you or any third party from the use of information included in the STREAMEE LOYALTY PROGRAM service. At the same time, the Company assumes no responsibility for third party content, as discussed above, any promotional advertisements and/or services that may be offered by third parties through the STREAMEE LOYALTY PROGRAM service and shall not be liable for any transaction between you and any third party.

The STREAMEE LOYALTY PROGRAM service and its Content are provided “as is” and “as available” without any express or implied warranties or conditions of any kind. The Company makes no warranty of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement.

The Company makes no warranty as to the security of the STREAMEE LOYALTY PROGRAM service and its Content from viruses or other programs that may cause harm. The Company is not liable for any loss of data that may result from your inability to make proper use of it.

To the fullest extent permitted by applicable law, you release the Company from any claim, liability and/or demand you may have arising from your use of the STREAMEE LOYALTY PROGRAM service and/or the Content.

To the maximum extent permitted by applicable law, the Company shall not be liable in civil or criminal liability for any damages (whether positive, special or consequential, which shall include, but not be limited to, disjointed and/or cumulative, loss of profits, data, lost profits, monetary damages, etc.). ) that you or a third party may suffer from a cause related to the operation or non-operation and/or use of the STREAMEE LOYALTY PROGRAM service and/or its Content and/or the inability to provide services and/or information available from it.

Your personal data resulting from the use of the STREAMEE LOYALTY PROGRAM service, such as through your participation in contests, are kept for as long as you are an active subscriber to the STREAMEE platform. In case of de-registration, your data will be deleted in a way that it is not technically feasible to retrieve them or they will be anonymized.

Your personal data that we may process are the following:

– Data that is necessary for the purpose of your participation in the STREAMEE LOYALTY PROGRAM, such as, but not limited to: an email to register for the Program.

Data that you provide to us for the purpose of participating in contests through the use of the STREAMEE LOYALTY PROGRAM, such as:

– Contact details, such as Name, City, PC, Contact Phone (mobile or landline), Email etc.

The recipients of your personal data may be third party companies with whom we cooperate for the design, technical support and improvement of STREAMEE, in particular the general partnership “SOLUTIONS ENCODICA Software Development Ltd.”, which provides technical support for the implementation of the STREAMEE LOYALTY PROGRAM.

Protection of intellectual property

Activity that may infringe intellectual property rights is not tolerated by the Company. Upon any notice from an intellectual property owner, the Company will remove any material from the STREAMEE LOYALTY PROGRAM service that we believe infringes the intellectual property rights of a third party by accessing it through the STREAMEE LOYALTY PROGRAM service.

Applicable Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of Greece and for any dispute arising out of this agreement, exclusive jurisdiction shall be that of the Greek courts.

Use – Age

If you are under 18 years of age, you may not access and/or use the STREAMEE LOYALTY PROGRAM service, nor register to create your own Account. In addition, only those who reside permanently in Greece are eligible to participate in the STREAMEE LOYALTY PROGRAM service.

The entire Contract

The foregoing Terms together with the “Privacy Policy” bind the parties (you and the Company) collectively and constitute the entire agreement of the parties and supersede any and all prior and current agreements between you and the Company.

Assignment

The Company may assign the Agreement and any of its rights and obligations under it. You may not assign the Contract, in whole or in part, or transfer to any third party your rights under the Contract.

Consent

By using the STREAMEE LOYALTY PROGRAM service, you accept and consent to the Privacy Policy, which can be found on the STREAMEE app, as well as these Terms of Use.
